Terms of Service

1. Acceptance of Terms

By accessing or using the Nommie application, website, and related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Nommie, Inc. (“Nommie,” “we,” “us,” or “our”).

2. Description of Service

Nommie is an AI-powered nutrition tracking platform that allows users to log food intake through photo recognition, natural language input, barcode scanning, and manual entry. The Service provides estimated nutritional information, personalized insights, and AI-assisted dietary guidance.

Important: Nommie is not a medical device and does not provide medical advice. Nutritional estimates are approximations generated by AI and should not be relied upon for medical dietary requirements. Always consult a qualified healthcare provider for medical nutrition advice.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of applicable laws
• Attempt to reverse engineer, decompile, or disassemble any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Create multiple accounts to circumvent usage limits or restrictions
• Upload content that is harmful, abusive, or violates the rights of others
• Use automated systems or software to extract data from the Service (scraping)

5. Subscriptions and Payments

Nommie offers both free and paid subscription tiers. Paid subscriptions are billed on a recurring monthly basis. By subscribing to a paid plan, you authorize us to charge your chosen payment method on a recurring basis until you cancel.

Prices are subject to change with 30 days' notice. Subscriptions purchased through the Apple App Store or Google Play Store are subject to the respective platform's terms and billing policies. You may cancel at any time and retain access to paid features until the end of your current billing period.

6. Intellectual Property

The Service and its underlying technology are owned by Nommie and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

You retain ownership of any content you submit. By submitting content, you grant Nommie a worldwide, non-exclusive, royalty-free license to use, process, and analyze such content to provide and improve the Service.

7. AI-Generated Content & Third-Party Data Sharing

Nommie uses AI to analyze food images, estimate nutritional content, and provide dietary suggestions. AI outputs are estimates and may contain inaccuracies. Nommie does not guarantee the accuracy, completeness, or reliability of any AI-generated nutritional data.

Third-party AI processing: When you use the photo scan feature, your food photos are sent to Google LLC's Gemini AI service for nutritional analysis. No other personal information is included. You may use Nommie's manual logging features without sharing any data with Google. For full details, see our Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by law, Nommie shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or reliance on the Service.

Our total liability shall not exceed the amount you paid to Nommie in the twelve (12) months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may request deletion of your account at any time through the app settings or by contacting support.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the “Last updated” date. Continued use after changes take effect constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the State of Delaware. Any disputes shall be resolved in the state or federal courts located in Delaware.
